Terms
Last updated 22 October 2026
These terms are an agreement between you and Site Assistant, which provides Site Assistant (“we”, “us”). You accept them when you create an account. Version 2026-10-22.
1. For businesses only
Site Assistant is offered only to businesses and professionals. By creating an account you confirm that you act for your business, trade or profession and not as a consumer. Consumer rules, such as the right of withdrawal, therefore don't apply.
2. The service
- Site Assistant gives your website an AI assistant that answers visitors from your website and the information you add.
- The free plan includes a limited number of answers per month. Paid plans and extra answers are described on the pricing page.
- “Try it on your website” previews are temporary, limited and deleted after 24 hours unless you create an account.
3. AI answers
- Answers are written by AI. They can be incomplete or wrong. We don't guarantee that any answer is accurate.
- Answers aren't offers or commitments by you or by us. The assistant is instructed not to confirm bookings, prices, orders, discounts or refunds, and to refer visitors to you for anything binding.
- Check what your assistant says regularly, keep your information up to date, and correct it when an answer is wrong.
- The assistant always tells visitors it is an AI, as the EU AI Act requires. Don't hide or remove that.
4. Your responsibilities
- You have the right to use everything you give the assistant, including the websites you let it read.
- You tell your website's visitors, in your privacy policy, that you use an AI chat assistant and that we process the conversations for you.
- You follow the law, including privacy, consumer and advertising law, towards your own visitors and customers.
- You keep your password safe and tell us at once if you think your account is misused.
5. What it may not be used for
- Anything illegal, misleading, harassing or harmful, or practices prohibited by the EU AI Act.
- Medical, legal or financial advice about someone's own situation, or decisions about people (such as hiring, credit, insurance or access to services).
- Collecting special categories of personal data (such as health data), ID numbers or payment details through the chat.
- Content aimed at children, spam, or impersonating someone else.
- Attacking, overloading or reverse engineering the service, or reading websites you don't own or may not use.
6. Prices and payment
- Prices are in euros and exclude VAT. Paid plans are billed monthly in advance through Mollie, on the payment method you authorise at your first payment. Extra answers, if you turn them on, are billed afterwards with the next invoice and never exceed the monthly cap you set. An upgrade starts at once, with the difference for the rest of the month charged then; a downgrade starts at the next renewal.
- You can cancel at any time; the plan then runs until the end of the paid month. Paid months aren't refunded.
- If a payment fails, you have 14 days to pay the open invoice; after that your account moves to the free plan.
- We announce price changes at least 30 days in advance by email. They apply from your next billing month.
7. Your data and ours
- The data processing agreement is part of these terms. It covers how we process your visitors' conversations for you. Our privacy policy covers your own account data.
- You keep all rights to your content. You allow us to store and process it only to provide and secure the service.
- We own the software. You may use it for as long as you have an account.
8. Availability and changes
- We work to keep the service available and secure, but don't guarantee that it's always available or free of errors. We may do maintenance and change features.
- We announce material changes to these terms at least 30 days in advance by email. If you don't agree, you can cancel before they take effect.
9. Suspension and ending
- We may pause an assistant or account that breaks these terms, puts the service or others at risk, or when the law requires it. Where we can, we tell you first.
- You can delete your account at any time in the dashboard. Your assistants and conversations are then deleted immediately.
10. Liability
- Our total liability is limited to the amount you paid us in the 12 months before the event that caused the damage, or €100 if that is more.
- We aren't liable for indirect damage, such as lost profit, lost data, business interruption, or damage caused by visitors relying on AI answers.
- These limits don't apply to damage caused by our intent or deliberate recklessness.
- You indemnify us against claims from third parties, including your visitors, that result from your content or from using the service in breach of these terms or the law.
- We aren't liable for failures caused by circumstances beyond our control, such as outages at our suppliers.
11. Referrals, founding customers and partners
- Referrals: when an account you referred makes its first payment, you both get account credit worth one month of Starter. Credit is used on future invoices and can't be paid out.
- Founding customers: the founding price applies to the Starter plan for as long as the subscription stays active, and only for the limited number of accounts we announce.
- Partners: approved partners earn a share of the payments (excl. VAT) of customers they referred, as shown in their dashboard, for as long as those customers pay and the program runs. We pay monthly once at least €50 is due, against the partner's invoice. Commission on refunded or reversed payments lapses.
- No spam, no ads on our brand name, no referring your own or fake accounts. We may refuse or withdraw rewards and commission that break these rules, and change or end the programs with 30 days' notice.
12. Law and disputes
Dutch law applies; the Vienna Sales Convention (CISG) doesn't. Disputes go to the competent court in Amsterdam.
